§ 1.0Acceptance & eligibility
By creating a WayHopper account, embedding our checkout, or running an event using our products, you agree to these Terms of Service ("Terms"). If you accept these Terms on behalf of an organization, you confirm you have authority to bind that organization.
§ 1.1Who can use WayHopper
You must be at least 16 years old to hold an account. Organizers running family-friendly events with minor participants must collect parental consent themselves; see the Privacy Policy § 9.
§ 1.2Plain-English summary
You agree to these terms by using WayHopper. Don't sign up for a friend; don't sign up on behalf of an org you don't represent.
§ 2.0Your account
You're responsible for keeping your password safe, for activity that happens under your account, and for keeping contact information current. We strongly encourage two-factor authentication; it's free, in your settings, and prevents most account compromises we see.
- One account per person. Shared logins violate these Terms.
- If you suspect compromise, email [email protected] immediately.
- We can suspend accounts that show signs of automated abuse, fraud, or impersonation.
§ 3.0Plans & payment
Current plans and prices are on our Pricing page. The Starter (Free) plan includes private events with up to 10 participants per event and up to 20 live events. The Organizer plan includes a WayHopper platform fee starting at $3 per ticket, with no monthly subscription — see § 4.
§ 3.1Refunds
If you cancel within 14 days of starting a paid plan and have not yet run an event on it, we refund the full amount. After that, plans are non-refundable but we'll pro-rata credit the remaining months toward another plan or another customer's account at your direction.
§ 3.2Taxes
Prices on our marketing pages are exclusive of GST/VAT/sales tax. Tax is added at checkout based on your billing address.
§ 4.0Ticketing & vendor revenue
On the Organizer plan, a WayHopper platform fee applies starting at $3 per ticket (no monthly subscription on that plan). Payments are processed by Stripe; their standard fees apply separately. Exact fee details on the Pricing page are the source of truth for current rates.
For participant-paid events, organizers connect Stripe Connect Express. WayHopper collects ticket payments and transfers the organizer share after the event under platform payout rules. You're responsible for collecting and remitting any taxes due on revenue you receive.
§ 5.0Acceptable use
Don't use WayHopper to do any of the following, and don't help someone else do them:
- Run illegal events, including gambling that isn't licensed under your local law (note: a poker run is not gambling in most jurisdictions — we're talking about actual house games).
- Scrape, copy, or republish other organizers' rosters, sponsors, or routes.
- Harass, dox, or threaten other users.
- Send spam through any WayHopper-provided email or SMS tooling.
- Probe, scan, or pen-test our infrastructure without prior written consent (we welcome real reports via [email protected]; coordinated disclosure policy in /security).
§ 6.0Your content
Routes, roster lists, event names, sponsor logos, and photos you upload remain your content. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and process your content solely to operate the service. We never use your content for our own marketing without separate written consent.
§ 6.1Photo challenges
Participants who upload photos to an event grant the organizer a license to use those photos for that event. They do not grant a license to WayHopper or to other participants.
§ 7.0Our IP & license to use the service
The WayHopper name, kangaroo-on-motorcycle mark, software, dashboards, and documentation are ours (or our licensors'). We grant you a limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose, subject to these Terms.
§ 8.0Service levels & uptime
We target 99.95% monthly uptime on the operator dashboard and event-day endpoints. If we miss it, the SLA in your order form (or our standard SLA for self-serve customers) applies. Status, incident history, and post-mortems are at status.wayhopper.com.
§ 8.1Event-day weight
If you're running an event with more than 2,000 simultaneous participants, give us 7 days notice via [email protected] so we can pre-scale infrastructure for you. There is no extra charge.
§ 9.0Termination
You can close your account any time from your account settings. We can terminate or suspend your account if you breach these Terms — material breaches we'll usually flag with 14 days' notice and a chance to cure; safety, fraud, or legal-compliance breaches we can act on immediately.
On termination, you have 30 days to export your data via /export. After that, the data is permanently deleted per the Privacy Policy § 7.
§ 10.0Liability & warranty
Subject to applicable consumer law (which we will not contract around — particularly under the Australian Consumer Law), WayHopper is provided "as is". We do not warrant uninterrupted service or that the service is bug-free. To the maximum extent permitted by law, our aggregate liability under these Terms is capped at fees paid to us in the prior 12 months.
Nothing in these Terms limits liability for fraud, willful misconduct, or anything else that cannot be limited by law.
§ 11.0Indemnification
You agree to indemnify WayHopper from third-party claims arising out of your content, your events, your acceptable-use breaches, and your failure to comply with applicable law. We agree to indemnify you against third-party IP-infringement claims related to the WayHopper service itself, subject to standard procedural conditions.
§ 12.0Governing law & disputes
Governing law depends on your billing region:
- APAC — Queensland, Australia. Courts of Brisbane.
- EU/EEA/UK — Ireland. Courts of Dublin.
- Americas — Delaware, USA. Federal courts of Delaware.
Before bringing a claim, you agree to attempt resolution in good faith for 30 days via [email protected]. Where applicable, you have the right to bring small claims in your local jurisdiction; nothing here removes that right.
§ 13.0Changes & contact
We may revise these Terms occasionally. Material changes get a 30-day email notice to active account holders. Non-material changes (typos, clarifications) are listed in the version history below.
